Объективная сторона мелкого коммерческого подкупа, как и основного состава коммерческого подкупа выражается в трех аспектах.Во-первых, в самом действии – в получении лицом или в передаче лицу, выполняющему в организации управленческие функции средства подкупа, в оказании услуг или предоставлении прав.Во-вторых, в средствах подкупа – деньги, ценные бумаги, иное имущество, услуги имущественного характера или иные имущественные права.В-третьих, в характере действий – незаконность.По последнему признаку коммерческий подкуп отграничивается от предусмотренного правилами делового этикета, внутренними правилами организации поощрения работников, от подарков и представительских расходов2.
