Особенности правовой регламентации уголовной ответственности за уклонение от административного надзора в уголовном законодательстве стран ближнего зарубежья

Изучение зарубежного опыта правового регулирования института административного надзора за лицами, отбывшими наказание, и вопросов уголовной ответственности за уклонение от административного надзора, позволяет комплексно рассмотреть данный институт, сопоставить схожие и отличительные черты, а также выявить наиболее эффективные механизмы противодействия общественно-опасным преступным проявлениям.

В связи с исторической и культурной близостью Российской Федерации и стран бывшего СССР, именно данные страны представляют интерес для анализа вопросов уголовной ответственности за уклонение от административного надзора.Анализ зарубежного уголовного законодательства, регламентирующего применение мер административного надзора, за лицами совершившими преступление и особенностей уголовной ответственности за уклонение от прохождения такого надзора (контроля), позволяет констатировать, что в большинстве стран постпенитенциарный надзор используется как средство индивидуального предупреждения преступлений.В свою очередь, именно наличие в уголовном законе соответствующего состава преступления, предусматривающего уголовную ответственность за уклонение от административного (постпенитенциарного) надзора (контроля), позволяет реализовывать данный инструмент специальной превенции.

Используемые термины: административный надзор, постпенитенциарный надзор, постпенитенциарная пробация, рассматриваются как однопорядковые, так как, по существу, не меняют содержание данного института состоящего в осуществлении совокупности мер контроля за поведением лица, отбывшего наказание в целях проверки его исправления, недопущения повторения им противоправного поведения и оказания ему социальной помощи (ресоциализации)1.

Зачастую данная мера выражается не только в надзоре за поведением лиц, ранее совершивших преступление, но и в оказании им социальной помощи (ресоциализации).В связи с этим, осуществление надзора за указанными лицами может передаваться службам пробации (либо аналогичным по функциям).Например, УК Грузии, УК Армении.УК Азербаджанской республики не содержат специальных норм, предусматривающих уголовную ответственность за уклонение от административного надзора, а регламентируют уклонение от пробационного контроля как основание для отмены пробации и замены ранее назначенного наказания, не связанного с лишением свободы на иной вид наказания.

В странах, криминализующих уклонение лиц, находящихся под надзором, от предписанных им обязательств или ограничений, как правило, имеет ступенчатую (постепенную) криминализацию, реализуемую через институт административной преюдиции.При этом конструкция административной преюдиции как правило базируется на повторности нарушения в течении одного года.

Так, в ст.226 УК Узбекистана2 повторное нарушение установленных правил административного надзора лицом, ранее подвергнутым административному взысканию за аналогичное нарушение, образует состав преступления.Туркменистане и Белоруссии преступление образует нарушение предписаний в рамках превентивного надзора в третий раз (лицом, дважды привлеченным к административному взысканию в течении года).

Как правило криминализация затрагивает два самостоятельных способа уклонения: либо уклонение от надзора путем неприбытия к месту проживания, либо злостное неисполнение возложенных судом обязательств.

В то же время, конструкция административной преюдиции как правило не распространяется на неприбытие лицом к месту жительства после отбытия наказания в установленный срок.Несомненно, логика законодателя строится на опасности изначального отказа от устанавливаемого административного надзора.Однако, представляется, что с точки зрения криминализации данные формы преступного поведения должны быть приравнены.

В то же время УК Казахстана3, признает уклонением две формы поведения: 1) самовольное оставление поднадзорным места жительства или 2) неприбытие поднадзорного в течение пяти суток без учета выходных и праздничных дней к избранному месту жительства.Таким образом нарушение иных обязательств и ограничений, установленных в рамках административного надзора, остается за рамками рассматриваемого состава преступления.

Субъективные признаки уклонения характеризуются как правило указанием на злостность – дополнительно подчеркивающую умышленный характер деяния.В отношении же специальной цели – (с целью уклонения от такого надзора (ст.243 УК Туркменистана4), подходы отличаются.В некоторых случаях законодатель посчитал данный признак излишним (например, УК Казахстана), и соответственно не включил его в диспозицию.

В качестве позитивного опыта, заслуживающего внимания и интеграции в конструкцию состава ст.314.1 УК РФ можно рассматривать используемое в ст.341 УК Казахстана указание на временной промежуток, истечение которого позволяет рассматривать невыполнение лицом предписаний административного надзора как преступное.Данный срок по сути является неким демпфером, позволяющим учитывать как объективные трудности, связанные с выполнением отдельных предписаний, так и предоставляющим время на осмысление своего поведения лицу, освобожденному из мест лишения свободы и находящемуся в стрессовом состоянии.

The article examines the provisions of the legislation of the countries of the former USSR, containing the institution of administrative supervision of persons who have committed a crime (or similar institutions of probationary control, post-penitentiary control, etc.), as well as establishing criminal liability for evading such supervision. In the course of a comparative analysis, the author reveals the positive aspects of the regulation of this institution in foreign criminal legislation, considers significant features of the elements of crimes and proposes a mechanism for improving criminal liability for evading administrative supervision within the framework of domestic legislation.
