Дифференциация уголовной ответственности и наказания посредством привилегированных признаков составов преступлений в Уголовном кодексе Республики Беларусь

Привилегирующие признаки состава преступления можно определить как признаки состава преступления, которые свидетельствуют о значительно пониженной, относительно основного состава, общественной опасности деяния, используемые законодателем для конструирования менее опасной разновидности деяний и для определения в законе новых пределов наказуемости, ослабленной санкции по сравнению с установленной в основном составе преступления.

Привилегирующие обстоятельства устанавливаются законодателем и относятся к признакам состава преступления1, правовая природа привилегирующих признаков определяется тем, что они входят в совокупность признаков состава преступления и обладают характерными для него чертами, влияют на уголовно-правовую оценку содеянного, существенным образом изменяют санкцию в сторону уменьшения, относительно общего типового наказания, предусмотренного за общее типовое преступление2.

Так, например, за совершение убийства, предусмотренного ст.139 УК Республики Беларусь, являющегося общим типовым преступлением против жизни, санкцией предусматривается наказание в виде лишения свободы на срок от шести до пятнадцати лет.В санкциях же статей, предусматривающих привилегированные составы убийства, предусматривается наряду с лишением свободы и более мягкий вид наказания – ограничение свободы, при этом максимальный срок лишения свободы может составить пять лет.Таким образом, привилегирующие признаки применяются законодателем для конструирования менее опасной разновидности деяний, что позволяет установить в законе новые пределы наказуемости, произвести смягчение санкции.Вместе с тем важно отметить, что привилегированные признаки не являются конститутивными признаками типового преступления, т.е.не являются криминообразующими признаками общественно опасного деяния.Поэтому привилегирующие признаки не могут рассматриваться отдельно от основного (типового) состава преступления.Признаки привилегированного состава преступления наряду с признаками основного состава являются признаками состава и служат основанием уголовной ответственности, определяя уголовную противоправность деяния определенного вида.

В научной литературе по уголовному праву в качестве основной функции привилегирующих признаков называется функция дифференциации уголовной ответственности, что находит свое отражение в ряде предметных институтов Уголовного кодекса3 (например, предметный институт преступлений против жизни и здоровья, имеет юридические конструкции основного, квалифицированного и привилегированного составов убийства, а также умышленного причинения тяжкого телесного повреждения).

Посредством привилегирующих признаков законодатель вводит в элементы состава преступления факторы, определяющие наряду с наличием общественной опасности, еще и ее степень4.

Так определяется существенное изменение уровня общественной опасности как самого деяния, так и лица, его совершившего, по сравнению уровнем, закрепленным с использованием признаков основного состава.Однако привилегированные признаки носят «локальный», а не универсальный характер, являясь юридически значимыми только для преступлений определенного вида, либо же только для отдельных составов преступлений.Так, например, признаки «мать», «ребенок», время – период родов или непосредственное их окончание, в диспозиции ст.140 УК Беларуси (убийство матерью новорожденного ребенка) характерны в качестве смягчающих наказание обстоятельств только для определенного вида преступления – убийства.При этом привилегирующие признаки, введенные в состав преступления, изменяют его квалификацию, появляется новая санкция, что влечет за собой дифференциацию наказания.

Анализ привилегированных составов преступлений показывает отсутствие системного единообразного подхода законодателя к использованию данного средства дифференциации уголовной ответственности.Например, такие обстоятельства, исключающие преступность деяния, как необходимая оборона (ст.34 УК) и причинение вреда при задержании лица, совершившего преступление (ст.35 УК), в Уголовном кодексе Беларуси учтены в качестве привилегирующих признаков таких привилегированных составов преступлений, как убийство при превышении пределов необходимой обороны (ст.143 УК), убийство при превышении мер, необходимых для задержания лица, совершившего преступление (ст.143 УК).Вместе с тем, схожие обстоятельства, исключающие преступность деяния, такие, как крайняя необходимость (ст.36 УК), деяние, связанное с риском (ст.39 УК), исполнение приказа или распоряжения (ст.40 УК), а также обстоятельства физического или психического принуждения, имеющие схожую правовую природу, необоснованно не были использованы законодателем для дифференциации уголовной ответственности в сторону ее смягчения.

Дискуссионным в уголовном праве является вопрос об унификации смягчающих (отягчающих) ответственность обстоятельств и привилегирующих (квалифицирующих) признаков состава преступления.Позиция законодателя по этому вопросу четко определена в ч.3 ст.63 УК, которая содержит запрет на учет смягчающего обстоятельства, предусмотренного статьей Особенной части УК в качестве признака преступления, как обстоятельства, смягчающего ответственность виновного.

При этом, полагаем обоснованной идею о возможности включения в главу 19 Особенной части УК Республики Беларусь «Преступления против жизни и здоровья» новых привилегированных составов преступлений против жизни и здоровья на основе таких привелигирующих признаков, как:

  • превышение пределов крайней необходимости;
  • совершение общественно опасного посягательства под влиянием физического или психического принуждения, вследствие которого лицо сохраняло возможность руководить своими действиями;
  • совершение общественно опасного посягательства при нарушении условий обоснованного риска.

Представляется, что УК Республики Беларусь имеет резерв по дальнейшей дифференциации уголовной ответственности посредством моделирования новых привилегированных составов.

Например, полагаем обоснованным выделение ряда привилегированных составов, включающих привилегирующие обстоятельства, составляющие элементы мотивационной деятельности субъекта.

Возможно формулирование привилегированного состава кражи по признаку ее совершения вследствие тяжелого личного материального положения или близких виновному лиц. При этом поместить его можно в одну из частей ст.205 УК, соглашаясь с тезисом, выдвинутым А.Ю. Булановым, о целесообразности создании самостоятельной «смягченной» (привилегированной) части статьи, предусматривающей типовое преступление, при моделировании привилегированных составов5.Кроме того, неправильное понимание истинных интересов службы виновным лицом могло бы лечь в основу формулирования привилегированного состава такого преступления, как принуждение к даче показаний (ст.394 УК), совершенное вследствие ложно понятых интересов службы.

Таким образом, отметим, что в доктрине уголовного права не выработана единая система факторов, лежащих в основе привилегирующих признаков составов преступлений, кроме того регламентация указанных признаков в Особенной части Уголовного кодекса Республики Беларусь не носит системного характера.Законодатель должен стремиться к максимальной дифференциации уголовной ответственности и наказания непосредственно в уголовном законе.И одним из таких средств дифференциации выступают привилегирующие признаки, используемые для конструирования менее опасной разновидности деяний.

Значение привилегирующих признаков состоит в том, что они позволяют градировать типовое наказание, отражая в законе характерную (существенно пониженную) степень общественной опасности, для установления в санкциях статей УК адекватных мер уголовной ответственности, соответствующих пониженной степени общественной опасности.

Привилегирующие признаки, являясь средством дифференциации уголовной ответственности, не могут отождествляться со средствами индивидуализации наказания. Их необходимо отграничивать от обстоятельств смягчающих ответственность, предусмотренных ст.63 УК Республики Беларусь, которые, воздействуя на степень общественной опасности, служат средством индивидуализации наказания в рамках санкции статьи Особенной части, а в определенных законом случаях позволяют выйти за пределы санкции для снижения срока (размера) наказания.

Еще одним существенным свойством привилегирующих признаков является то, что они носят производный характер, т.е.конкретизируют содержание признаков основного (типового) состава преступления, снижая характер или степень его общественной опасности.

В доктрине уголовного права в качестве специальных критериев, на основе которых возможно выделение привилегирующих признаков и осуществление с их помощью процесса моделирования привилегированных составов, выделяют: характер и степень общественной опасности содеянного; криминологическую характеристику преступления и личности лица, его совершившего; соответствие привилегирующих признаков характеру содеянного либо одновременно преступлению и личности преступника.
