Законодательная техника построения уголовно-правовых норм, закрепляющих круг преступных деяний, зависит в первую очередь от социально-экономических процессов, которые происходят в обществе.Запрет любого преступления является социально обусловленным, поскольку оно способно причинить существенный вред общечеловеческим ценностям.В соответствии со ст.11 Уголовного кодекса Республики Беларусь (далее – УК) преступление определяется через его общественную опасность (материальный признак преступления) и наличие признаков, предусмотренных УК (формальный признак).

Обращаясь к общественной опасности как базовому признаку преступления, отметим, что она положена в основу построения целого ряда институтов уголовного права.Так, общественная опасность определяет категорию преступления и критерии малозначительности деяния.В ч. 1 ст. 12 УК закреплено, что преступления в зависимости от характера и степени общественной опасности подразделяются на преступления, не представляющие большой общественной опасности, менее тяжкие, тяжкие и особо тяжкие.Ст.ст. 28-29 УК, раскрывающие понятие невменяемости и уменьшенной вменяемости, также упоминают «фактический характер и общественную опасность действия», а ст.ст.34-35 УК используют понятие «общественно опасное деяние».Ст.62 УК, закрепляющая общие подходы к назначению наказания, при определении вида и размера справедливого наказания предписывает суду учитывать характер и степень общественной опасности совершенного преступления.Ст.70 УК «Назначение более мягкого наказания, чем предусмотрено за данное преступление» позволяет суду в исключительных случаях учитывать ряд обстоятельств, которые существенно уменьшают степень общественной опасности деяния и позволяют назначить более мягкое наказание.Утрата деянием или лицом общественной опасности является основанием для освобождения лица от уголовной ответственности (ст. 87 УК).Общественная опасность также является инструментом воплощения в жизнь такого признака преступления, как наказуемость, определяя соразмерную совершенному деянию меру уголовной ответственности.Построение санкций статей Особенной части УК также основано на общественной опасности.Следовательно, построению согласованной системы уголовно-правовых норм предшествует определение содержания и методики измерения общественной опасности.

Как показывает анализ норм Общей и Особенной частей УК, категория «общественная опасность» применяется для определения преступления, деяния, обстоятельств, исключающих преступность деяния, учитывается при принятии решения о виде и размере подлежащего применению наказания, для освобождения от уголовной ответственности и в ряде других случаев. Несмотря на важность категории «общественная опасность» в уголовном праве, ее понятие и методика измерения не были закреплены на законодательном уровне и являются актуальным направлением исследования в уголовном праве.

Под общественной опасностью традиционно понимается способность деяния причинить существенный вред охраняемым уголовным законом общественным отношениям.

Однако относительно методики измерения общественной опасности в научной литературе не было сформировано однозначной точки зрения, в связи с чем, представляется целесообразным проанализировать различные авторские концепции.

Например, И.А.Солодков выделил два критерия измерения общественной опасности преступления: качественный уровень причиненного вреда и степень злонамеренности лица, его причинившего1.В.П. Нажимов предложил измерять общественную опасность преступления исходя из содержания санкции статьи Особенной части уголовного закона.При этом он отметил, что предложенная методика может работать только в том случае, если изначально санкции отражают реальную общественную опасность преступления2.Однако А.Б.Сахаров полагает, что во всех институтах, составах и санкциях уголовного закона нет последовательного проведения идеи единой дифференциации преступлений по степени их тяжести по санкциям, в связи с чем общественная опасность как объективная категория уголовного права не может быть поставлена в зависимость от уголовно-правовых санкций3, которые определяются произвольно (в науке уголовно права отсутствуют правил законодательной техники построения санкций с учетом иерархии объектов уголовно-правовой охраны).По мнению Ю.Д.Блувштейна, общественную опасность преступления возможно измерить методом экспертных оценок4.Однако при использовании метода экспертных оценок неизбежен определенный субъективизм, т.к.результаты напрямую зависят от уровня правосознания и профессиональной компетентности респондентов.

Д.О.Хан-Магомедов рассматривал методику измерения общественной опасности преступления в контексте авторской методики сравнительной оценки тяжести уголовных наказаний, суть которой заключается в определении «индекса жесткости судебной репрессии», рассчитываемого с помощью математических формул5.Однако, как справедливо отмечалось в научной литературе, методика Д.О.Хан-Магомедова отражает общественную опасность конкретного преступления, а не общественную опасность преступлений одного вида, описанных в диспозиции конкретной статьи Особенной части уголовного закона.

В Республике Беларусь общепринятой является методика определения степени общественной опасности с учетом категорий, закрепленных в ст. 12 УК и на основании границ санкций статей Особенной части УК.Определение характера общественной опасности происходит на основании измерения ценности объекта уголовно-правовой охраны.Для определения ценности объекта, который подвергся посягательству, следует обратиться к санкции, формирование которой законодателем в некоторых случаях происходит без учета реальных социальных процессов, происходящих в обществе.Во избежание обозначенной проблемы формированию санкций статей Особенной части должно предшествовать измерение общественной опасности преступления на основании ценности объекта уголовно-правовой охраны.

Определить меру справедливого наказания за совершенное преступление без определения его общественной опасности затруднительно.Необходимо первоначально определить иерархию ценностей, которые образуют в совокупности объект уголовно-правовой охраны, затем с использованием инструментария измерить общественную опасность преступлений, а в последующем сформировать систему санкций УК с учетом деления преступлений на категории.При этом содержание каждой санкции статьи Особенной части УК должно соответствовать одной категории преступлений (см.напр.санкцию ч.1 ст.294 УК, которая предусматривает возможность применения лишения свободы «на срок до семи лет», в которой предусмотренное наказание объединяет фактически три категории преступлений, размывая общественную опасность).

На основании изложенного можно сделать вывод о том, что подходы к определению общественной опасности необходимо изменить, т.к.отсутствие законодательного определения общественной опасности затрудняет измерение общественной опасности конкретного преступления и отнесение его к одной конкретной категории.
