Тема моделирования уголовного закона до определенного момента развивалась достаточно слабо.Не сказать, чтобы этот вопрос не исследовали, но все ограничивалось рамками науки уголовного права и не имело реальной возможности реализации на практике.Сейчас, в связи со спецоперацией на Украине, ситуация начинает меняться.Старая либеральная модель сворачивается во многих сферах жизни нашего общества, что освобождает место для изменений и появления нового, открывается так называемое окно возможностей.В свете происходящей социальной трансформации тема моделирования может получить определенный импульс развития.По итогу изменений будет сформирована новая модель общественного устройства, что повлечет связанное с этим изменение уголовно-правового инструментария защиты общества.

Для нас привычно и закономерно, что технически сложные устройства (здания, сооружения, техника) создаются по плану (техническому заданию), использующему стандартизацию.Проектирование способствует реализации двух целей: 1) достижение целевых результатов; 2) исключение наступления вреда.В этом смысле нас не удивляет, что уголовный закон не моделируется, не проектируется, хотя является сложным явлением, для создания и изменения которого моделирование является наиболее результативным методом.В настоящее время проблему можно обозначить как отсутствие концептуального моделирования уголовного законодательства, выполненного в целях достижения эффективности уголовно-правового воздействия, реализованного на основе уголовно-правовых стандартов.

Ситуация с моделированием в уголовном праве выглядит достаточно интересно.С одной стороны, уголовный закон обладает большим потенциалом причинения социального ущерба, однако практическое применение моделирования является новой темой.С другой стороны, мы не можем сказать, что в уголовном праве отсутствуют моделирование или модели вообще.Они есть, но значительным образом отличаются от моделей в технических областях, и эти отличия существенны.Во-первых, эти модели не имеют детально проработанного образа, который описывал бы уголовно-правовое воздействие через достигаемый результат и эффективность.Во-вторых, модель выполнена на естественном языке, носит описательный характер с низкой степенью формализации.

В уголовном праве концептуальные модели в зависимости от сферы применения можно поделить на законодательные и научные.Первые представляют собой нормативно-правовой акт верхнего уровня, непосредственно не регулирующий общественные отношения, а выполняющий функцию унификации уголовного закона (модельный нормативно-правовой акт).В период СССР такой документ предшествовал принятию УК РСФСР и использовался для создания уголовного законодательства союзных республик.

Все модельные нормативные правовые акты предшествовали появлению очередного уголовного кодекса, за исключением Основ уголовного законодательства Союза ССР и союзных республик 1991 г., не реализовавших эту возможность в связи с распадом государства.В целом такая схема понятна и служит целям стандартизации уголовного законодательства на общей территории действия уголовно-правового регулирования.Так, отдельные уголовные законы продолжают отражать национальные особенности, при этом строятся на едином методическом ядре.После разрушения СССР и образования на основе части союзных республик СНГ подходы к формированию уголовного законодательства остались прежними, только место союзных республик заняли независимые государства с единой системой ценностей.

Такая модель организации уголовного законодательства не является новой или уникальной.Так, в США наблюдается подобная схема обеспечения унификации, но с меньшей степенью централизации: есть образец – системообразующий документ (Модельный уголовный кодекс США 1962 г.1), и есть уголовные законы отдельных штатов, которые в различной степени имплементируют законодательные идеи.Фактически Модельный уголовный кодекс США носит типовой характер и призван стимулировать законодательные органы штатов приводить в порядок, стандартизировать все элементы уголовной системы США.

Научные концептуальные модели в отличие от законодательных имеют несколько иные функции: демонстративную, исследовательскую, прогностическую и т.д.Примером таких моделей можно считать научные проекты уголовных кодексов, разрабатываемые различными коллективами авторов.Хронологический список установленных научных проектов уголовных кодексов выглядит следующим образом: 1) модель уголовного закона авторского коллектива под руководством Кудрявцева В.Н.2; 2) проект уголовного кодекса РСФСР (авторский коллектив: Марцев А.И., Царегородцев А.М., Клейменов М.П., Иващенко А.В.)3; 3) научный проект УК РФ авторского коллектива под руководством Лопашенко Н.А.4.

В целом научные концептуальные модели схожи с законодательными в том, что они имитируют уголовный закон и по форме изложения представляют собой некую совокупность правил, заключённых в структуру.

Фактически существующие концептуальные модели уголовного права основаны на предположении или мнении отдельного ученого, что говорит о начальном уровне моделирования.Основой концептуальной модели должна быть цельная система уголовно-правового воздействия, выработанная по результатам исследования полных статистических данных.Учитывая достаточный уровень развития информационных технологий, в моделировании следует переходить на фактологическую основу, где факт (а не предположение) станет отправной точкой для создания модели.

Новый уровень концептуального моделирования заключается в повышенных требованиях и основан на построении целостной системы понятий, детально описывающей уголовно-правовое воздействие.Для этого модель должна соответствовать трем критериям: 1) четко выражать конечную цель, декомпозированную на отдельные задачи, вплоть до отдельных действий исполнителей; 2) соединять теоретические положения с результатами практической деятельности (правоприменительной практикой, статистикой) для возможности оценки эффективности уголовно-правового воздействия; 3) выражать однозначное понимание уголовного закона, достигнутое через его системную формализацию и стандартизацию.

Видимо, время прорывных предложений в науке уголовного права сменяется на время планомерной системной работы по выстраиванию концептуальных основ уголовного права, приближенных к практике и формализованных на основе стандартов.
