На территории Российской Федерации в 2013 г.зарегистрировано 231 462 наркопреступления.Уровень наркопреступности – 161 наркопреступление на 100 тысяч населения2.Наибольший удельный вес в структуре наркопреступности составили преступления, связанные с незаконным сбытом наркотиков (ст.228.1 УК РФ) – 48,6% (112487 преступлений).Наркопреступления, не связанные со сбытом наркотиков (ст.228 УК РФ), составили 45,8% (106078).Удельный вес иных наркопреступлений составил 5,6%, в том числе организация или содержание притонов для потребления наркотиков (ст.232 УК РФ) – 1,9% (4391), контрабанда наркотиков (ст.188, 226.1, 229.1 УК РФ) – 0,9% (2167), незаконное культивирование растений, содержащих наркотические средства, психотропные вещества или их прекурсоры (ст.231 УК РФ) – 0,5% (1049) (рис.1)3.

Основные показатели динамики зарегистрированных преступлений, связанных с незаконным оборотом наркотиков, свидетельствуют о том, что в 2013 г.продолжилась сложившаяся в 2011 г.тенденция роста количества регистрируемых наркопреступлений.В сравнении с 2012 г.объем данных преступлений увеличился на 5,7% (рис.2).

В 2013 г.правоохранительными органами выявлены 117 912 лиц, совершивших преступления, связанные с незаконным оборотом наркотиков, что на 10,8% больше показателя 2012 г.(106 393).Как правило, это лица мужского пола в возрасте от 18 до 29 лет – 45,2%.Следующую возрастную группу составляют лица в возрасте от 30 до 39 лет – 36,6%.Удельный вес несовершеннолетних – 2,1% от общего всех выявленных лиц, совершивших наркопреступления.

В 2013 г.правоохранительными органами Российской Федерации из незаконного оборота изъято 33 т.335 кг наркотических средств, психотропных веществ, их аналогов4 и сильнодействующих веществ (-2,9% к 2012 г).Анализ изъятий наркотиков по их видам показывает, что в незаконном обороте наркотических средств на территории Российской Федерации преобладает марихуана, удельный вес которой составляет 77,4% от общего объема изъятых наркотиков.Второе место по распространенности занимает героин (6,3%), далее следует гашиш (5%) (рис.3).

Таким образом, в Российской Федерации в 2013 г.зафиксировано увеличение объема преступлений, связанных с незаконным оборотом наркотиков, при одновременном снижении объемов изъятий наркотических средств и психотропных веществ.Это может быть одной из причин высокой степени наркопораженность населения Российской Федерации5.

В заключении следует отметить, что на долю Российской Федерации приходится половина всех наркопреступлений регистрируемых в государствах-членах ОДКБ6 (рис.4).

Кроме этого в Российской Федерации превосходит другие стары ОДКД и по количеству изымаемых наркотических средств (таблица 1).

Полагаем, что уголовное законодательство Российской Федерации наиболее полно осуществляет охрану общественных отношений в сфере оборота наркотических средств и психотропных веществ, что позволяет выявлять большее количество наркопреступлений и тем самым в большей степени противостоять наркоагрессии.

Представляется целесообразным активизировать правотворчество в государствах-членах ОДКБ в области борьбы с наркопреступностью, и в первую очередь унифицировать уголовное законодательство.
